COMPULSORY PURCHASE

Compulsory purchase of land and property can prove a traumatic experience that leaves the owner displaced and out of pocket.  Our expertise is aimed at minimising the impact experienced by our clients in this respect and maximising the compensation due to them. 

In a recent case we handled, the local authority threatened to compulsory purchase our developer client’s property on the basis that it had sat empty for an inordinate period of time and was in an advanced state of disrepair.  Our client wished to resist this and he appointed us to represent him in the matter. 

There are strict criteria that must apply before the local authority can assert their power to compulsory purchase property.  Having assessed the matter, we found that in our view, whilst some of the criteria were present, it was not enough to allow the local authority to assert their power to compulsory purchase.  We made representations accordingly on our client’s behalf and following our intervention the local authority took no further action.
